Important: By downloading, installing, or using Your Daily Light, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legal agreement between you and Your Daily Light ("we," "our," or "us") regarding your use of the Your Daily Light mobile application (the "App"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial use.

4.1 Account Creation

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access to or use of your account.

4.3 Account Deletion

You may delete your account at any time through the App's settings. Upon deletion, your personal information will be removed in accordance with our Privacy Policy.

5. Subscriptions and Payments

5.1 Premium Features

Certain features of the App may be available through paid subscriptions ("Premium Features"). Subscription fees are charged through your Apple App Store account.

5.2 Billing

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions through your Apple App Store account settings.

5.3 Refunds

All purchases are processed through the Apple App Store. Refund requests should be directed to Apple in accordance with their refund policies. We do not provide refunds directly.

5.4 Free Trial

If we offer a free trial, you may cancel at any time during the trial period without being charged. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

You acknowledge that all trademarks, service marks, trade names, and other intellectual property rights in the App belong to us or our licensors.

The App may contain links to third-party websites, services, or content. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

10. Disclaimers and Limitations of Liability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Your Daily Light and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another.

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12.2 Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by sending you a notification. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14.2 Arbitration

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Your Daily Light regarding the App.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
